1. Template Licensing & Usage

TribeVita templates are copyrighted and are not licensed under the GNU general public license.  Once a template has been purchased and it has been moved to your Business Catalyst partner portal, you may use Business Catalyst's replication feature to replicate this template for one or more client projects.  You are not allowed to redistribute TribeVita templates in any way.  You may not redistribute this template via your Online Business Builder (OBB).  

2. Photoshop Files License

The Photoshop design files for TribeVita Templates come packaged separately are not GPL licensed. They are licensed and copyrighted under TribeVita.com. You are not allowed to redistribute these files in any way.

3. Updates / Compatibility

It is our duty to always keep the templates up-to-date and working with the latest version of Business Catalyst. But, when Adobe releases new versions of Business Catalyst, we give no guarantee that older templates will run without problems. We are committed to the best of our ability to make all of our templates compatible with future features and releases.  If features updates are made to templates, post-purchase, you may need to purchase a new version of the template in order to take advantage of the added functionality.

4. Browser Compliance

Our templates support all modern web browsers including (but not limited to) Firefox, Safari, Chrome and Internet Explorer. While we strive to provide the best and most consistent experience across all browsers, it is impossible to compensate for the lack of web standards and support related to HTML and CSS. You are responsible for reviewing the templates via our preview link on each template product page and test browser compliance.

5. Delivery

After we have successfully received your payment, your template will be made available to you within 24 hours of purchase.  It will be housed, at that time, under the TribeVita partner portal.  At that time we will coordinate the move of your purchased template to your partner portal.  Typically, it takes 24-48 hours for Business Catalyst to move the template to your partner portal, however we cannot guarentee any time frame on their behalf.  You will receive an email with account information after your purchase. If an email is not received, contact us through our website. 

6. Ownership

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of TribeVita. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental, or consequential damages or other losses arising out of the use of or inability to use our products.

7. Site Content

All content, including imagery, published on TribeVita.com, including site content published onsite is property of TribeVita and is under copyright. Content or template designs shall not be used or exploited for any reason.

8. Refund Policy

Since TribeVita is offering non-tangible irrevocable, digital goods we do not issue refunds after multiple or individual purchases are made. You are responsible for understanding this upon registration and before any purchase is made.

9. Support

TribeVita offers these templates and designs “as is”, with no implied meaning that they will function exactly as you wish or with all 3rd party components or plugins. Further, we offer no support via email or otherwise for installation, customization, or administration of Business Catalyst.

10. Warranty

TribeVita does not warranty or guarantee these templates in any manner. We cannot guarantee they will function across all web browsers. Browser compatibility should be tested against the demonstration templates. Please ensure that the browsers you will work with the templates, as we cannot guarantee they will work with all browser combinations.

11. Prices

TribeVita reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently remove a template with or without notice. Prices of all products are subject to change at anytime without notice.

12. Linking to Sites

You are not permitted to link directly to any image or template offered by TribeVita. You agree not to download or use images hosted on TribeVita.com, for any purpose, including, without limitation, posting such images on another website.

You agree not to link from any other website to our templates in any manner such that our templates, are “framed,” surrounded or obfuscated by any third party content, materials, or branding.

13. Use of Stock Photography / Fonts

Our templates may contain stock photography that is licensed under a 3rd party stock photography provider. Under our license agreement with 3rd party stock photography providers, we have the right to distribute said photography in our templates in a "concept" form. This means, if you choose to use the concept images included in the template on your final website deliverable, you must obtain a site or customer license to each individual image. We do not have the right to transfer the stock photography license in the sale of a template. This is illegal. Likewise, using the concept photography in the final, live website is also illegal.

Our templates may also use 3rd party font providers that require a license agreement or special account to use. It is your responsibility to obtain these licenses on behalf of your client or instruct your client obtain the licenses. We are in no way transferring any font licenses to your or your customer, as it is illegal.
